1. Acceptance of terms
By creating an account, registering a school or otherwise using Cherry Scheduler, you agree to these Terms. If you use Cherry Scheduler on behalf of a school, you confirm that you are authorized to accept these Terms for that school. If you do not agree, please do not use the service.
In these Terms, "Cherry Scheduler", "we", "us" and "our" refer to the Cherry Scheduler service and the team that operates it, led by its founder, Nguyen Hoang An, in Ho Chi Minh City, Vietnam.
2. Description of Cherry Scheduler
Cherry Scheduler is web-based software that helps schools create and optimize timetables for teachers and classes. It lets schools enter classes, teachers, subjects, teaching assignments and scheduling rules, generates timetables using constraint-based scheduling and optimization techniques, and lets users review, edit and export timetables.
Generated timetables depend on the data and rules provided by the school. Some combinations of rules cannot all be satisfied at the same time; in those cases the software may leave lessons unscheduled or report rules it could not meet. Schools remain responsible for reviewing and approving the timetables they use.
3. Accounts
- You must provide accurate registration information, including a valid email address, and keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- Notify us promptly at contact@tkbcherry.com if you suspect unauthorized access to your account.
- Certain features or usage limits may depend on the plan associated with your school's account. Plan details are shown in the application.
4. Acceptable use
You agree not to:
- use the service for any unlawful purpose or in violation of applicable law;
- attempt to access accounts, data or systems that you are not authorized to access;
- interfere with or disrupt the service, including by overloading it with automated requests;
- reverse engineer, copy or resell the service except as permitted by law or with our written permission;
- upload malicious code, or content that infringes the rights of others;
- enter sensitive personal information that is not needed for timetabling, such as student personal records.
5. User-provided data
Schools keep ownership of the data they enter into Cherry Scheduler, including class, teacher, subject and timetable data. You grant us permission to store, process, copy and display that data only as needed to operate, secure, support and improve the service. You are responsible for the accuracy of your data and for having the right to provide it.
Our handling of personal information is described in our Privacy Policy. You can export your school's data from the application, and you can ask us to delete it by emailing contact@tkbcherry.com.
6. Availability of service
We work to keep Cherry Scheduler available and reliable, but the service is provided on an "as is" and "as available" basis. It may be interrupted for maintenance, updates, or reasons beyond our control, and we do not guarantee that it will always be available, uninterrupted or error-free. We recommend that schools keep their own exports of important timetables.
7. Intellectual property
The Cherry Scheduler software, website, scheduling engine, name, logo and related materials are owned by Cherry Scheduler and its founder and are protected by intellectual property laws. These Terms give you a limited, non-exclusive, non-transferable right to use the service for your school's timetabling needs. They do not transfer any ownership rights to you. Timetables you generate from your own data may be used freely by your school.
8. Limitation of liability
To the maximum extent permitted by applicable law, Cherry Scheduler will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or opportunities, arising from or related to your use of, or inability to use, the service. To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Changes to the service and these terms
We may add, change or remove features of Cherry Scheduler as the product develops. We may also update these Terms from time to time; when we do, we will update the effective date on this page and, for significant changes, make reasonable efforts to notify account holders. Continued use of the service after changes take effect means you accept the updated Terms.
10. Termination
You may stop using Cherry Scheduler at any time and may ask us to close your account. We may suspend or terminate access to the service if you breach these Terms, if required by law, or to protect the service or other users. Where reasonable, we will give notice and an opportunity to export your data before closing an account.
11. Governing law
These Terms are governed by the laws of Vietnam. We encourage you to contact us first so that we can try to resolve any concern informally.
